These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://our250story.com and any related online services, registrations, communications, content, and campaign pages associated with Our American Story (the “Service”).

Our American Story is an initiative of Moms for America®, operated by Moms for America, Inc. (“Moms for America,” “we,” “us,” or “our”), a Missouri nonprofit organization. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Use of the Website

You agree to use the Service only for lawful purposes and in a manner consistent with our mission. You may not:

    • Use the Service in any way that violates applicable laws or regulations
    • Attempt to interfere with the operation, availability, or security of the Service
    • Use the Service to distribute malicious software, spam, or harmful content
    • Misrepresent your identity or submit false information through the Service

We reserve the right to restrict, suspend, or terminate access to the Service for misuse.

2. Donations, Purchases, and Payments

If you make a donation, purchase merchandise, or register for an event through the Service, if those features are offered, you may be required to provide payment information.

You represent that you are authorized to use the payment method provided and that all information submitted is accurate and complete. Payments are processed through third-party payment processors. We do not store full payment card information.

We reserve the right to refuse or cancel transactions in cases of suspected fraud, processing errors, pricing errors, or violations of these Terms. Unless otherwise stated, donations are non-refundable to the fullest extent permitted by law.

3. Availability and Accuracy of Information

We strive to provide accurate and up-to-date information, but the Service may occasionally contain errors, omissions, or outdated content. We reserve the right to correct, revise, or update content at any time without notice.

We do not guarantee that all information on the Service will always be complete, current, or error-free.

4. Promotions and Campaigns

Any contests, sweepstakes, fundraising campaigns, ticketed events, or promotions offered through the Service may be governed by additional rules or terms. In the event of a conflict between these Terms and the terms for a specific promotion, the specific promotion terms will control.

5. Intellectual Property

All content on the Service, including text, graphics, logos, videos, images, designs, downloads, and other materials, is owned by or licensed to Moms for America for use in connection with Our American Story and is protected by United States and international intellectual property laws.

You may view, download, and print content from the Service for your personal, non-commercial use only. You may not copy, reproduce, modify, republish, upload, post, transmit, distribute, or use any content for commercial purposes without prior written permission.

6. Third-Party Links

The Service may include links to third-party websites, platforms, or services. We do not control and are not responsible for the content, privacy policies, terms, or practices of third parties. Your use of third-party sites is at your own risk.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or misuse the Service.

Any provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property, disclaimers, limitations of liability, indemnification, and governing law, will remain in effect.

8. Indemnification

You agree to indemnify, defend, and hold harmless Moms for America, its officers, directors, employees, volunteers, contractors, and agents from and against any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:

    • Your use or misuse of the Service
    • Your violation of these Terms
    • Any content or information you submit through the Service
    • Your violation of any rights of another person or entity

9. Limitation of Liability

To the fullest extent permitted by law, Moms for America shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Service.

Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us through the Service in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free from harmful components.

Content provided through the Service is for informational and educational purposes only and does not constitute legal, medical, financial, or professional advice.

11. No Guarantees or Outcomes

Moms for America does not guarantee any specific results, outcomes, or impacts from participation in Our American Story, related events, campaigns, educational materials, or other activities associated with the Service. Outcomes depend on many factors beyond our control.

12. Force Majeure

We are not responsible for delays, interruptions, or failures in performance caused by events beyond our reasonable control, including natural disasters, acts of God, war, terrorism, government actions, labor disputes, internet or utility outages, or failures of third-party providers.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Missouri, and you consent to the jurisdiction of those courts.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

15. Children’s Privacy

The Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If such information is discovered, it will be deleted promptly.

16. User Content and Testimonials

If you submit comments, testimonials, photos, videos, stories, or other content through the Service, you grant Moms for America a non-exclusive, royalty-free, worldwide license to use, reproduce, display, publish, distribute, and share that content in connection with its nonprofit, educational, editorial, or promotional purposes, unless you request otherwise in writing.

You represent that you have the rights necessary to submit such content and that it does not violate the rights of any third party.

If you would like us to remove a testimonial or other submitted content, you may contact us at Moms@MomsforAmerica.net. We will consider such requests in good faith but cannot guarantee removal from all past uses or archival materials.

17. Community Areas

If the Service includes public forums, comments, or other interactive features, information you share in those areas may be publicly visible. Please use caution when posting personal or sensitive information.

We reserve the right, but not the obligation, to remove content that we determine is unlawful, offensive, harmful, misleading, or inconsistent with our mission.

18. International Use

The Service is operated from the United States. By using the Service, you consent to the transfer, storage, and processing of your information in the United States and in other jurisdictions where our service providers operate.

19. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted on the Service. Your continued use of the Service after revised Terms are posted constitutes your acceptance of the updated Terms.

20. Miscellaneous

These Terms constitute the entire agreement between you and Moms for America regarding the Service and supersede any prior understandings relating to the Service.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other right.
